Yup, you\u2019ve concluded that your house is haunted and you\u2019re starting to think it\u2019s time to move.&nbsp;<\/p>\n\n\n\n<p>If you\u2019re worried no one will want to buy a place that comes with its own ghosts, think again. <strong>Haunted houses and stigmatized properties hit the market every day, and what\u2019s scary for one person can even be a selling point for someone else.<\/strong> Even some of the country\u2019s most notoriously spooky spots have become someone\u2019s happy new home.<\/p>\n\n\n\n<p>Here\u2019s everything you need to know about selling\u2014and buying\u2014a haunted house.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Questions we\u2019ll answer<\/h3>\n\n\n\n<ul class=\"wp-block-list\"><li>Does the law require sellers to disclose that a house is haunted?&nbsp;<\/li><li>What is a stigmatized property?&nbsp;<\/li><li>What are the disclosure rules regarding stigmatized properties?<\/li><li>Do people buy haunted and stigmatized houses?<\/li><li>Who lives in haunted houses?<\/li><li>What do I need to know about selling a haunted house?&nbsp;<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">Do I have to tell if the house I\u2019m selling is haunted?<\/h2>\n\n\n\n<p>The quick answer? No. While disclosure rules vary from state to state, nowhere in America are sellers required to disclose alleged paranormal activity because, well, it\u2019s very difficult to prove, from a legal standpoint, that a property is indeed haunted.<\/p>\n\n\n\n<p>It has been done! In 1991, a house in Nyack, New York, was declared legally haunted by the New York Supreme Court after owner Helen Ackley and her family claimed they were harassed by ghosts Ackley believed to be from the Revolutionary War era.<\/p>\n\n\n\n<p>The case\u2014<em>Stambovsky v. Ackley<\/em>, but generally referred to as the \u201cGhostbusters ruling\u201d\u2014concluded, \u201cSeller who had undertaken to inform the public at large about the existence of poltergeists on the premises to be sold was estopped to deny existence of poltergeists on the premises, so the house was haunted as a matter of law and seller must inform the purchaser of the haunting.\u201d<\/p>\n\n\n\n<p>Ghosts or not, you will have to mention if the paranormal presence has managed to affect the physical space. Did oozing green slime cause cracks in the foundation? Did a river of blood like the one in <em>The Shining<\/em> flood the hallway and cause damage? You\u2019ll have to give your potential buyers a heads up. Wouldn\u2019t you want to know?<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What is the difference between a haunted house and a stigmatized property?&nbsp;<\/h2>\n\n\n\n<p>A stigmatized property is different from a haunted house. Stigmatized properties are homes where something notorious has taken place, though that event may not have physically damaged the home in any way.<\/p>\n\n\n\n<p>Common causes of stigmatization include death, murder, suicide, and high-profile crime. Perceived hauntings can also cause a property to become stigmatized if, as in \u201cthe Ghostbusters ruling,\u201d the property\u2019s reputation and appeal have been tarnished by the claims.<\/p>\n\n\n\n<p>Whether or not you have to disclose that a home is stigmatized can be tricky, as disclosure laws vary from state to state. If you\u2019re the owner of a stigmatized home, you\u2019d be wise to familiarise yourself with your state\u2019s disclosure laws and how those laws define stigmatized properties. Your real estate broker can also help you understand the local situation.&nbsp;<\/p>\n\n\n\n<p>In Ohio, for example, the Residential Property Disclosure Form requires a seller to disclose only \u201cmaterial issues.\u201d Crime and perceived ghosts are not considered material issues, so a seller is not required to disclose such instances unless they physically affected the home.<\/p>\n\n\n\n<p>If a property is stigmatized, however, it\u2019d be wise to not hide that information from potential buyers, even if the law doesn\u2019t require you to do so.<\/p>\n\n\n\n<p>In 2014, an Ohio realty company was tasked with selling Jeffrey Dahmer\u2019s childhood home, a 1952 house that the family moved into in 1968. The Dahmer family was no longer living in the home in 2014, but it\u2019s no secret that the infamous serial killer grew up there and committed his first murder on the property.\u00a0\u00a0<\/p>\n\n\n\n<p>Trying to hide that from buyers may have been a temptation\u2014it\u2019s pretty alarming!\u2014but the listing team was up front about it.<\/p>\n\n\n\n<p>Jim Fox, Principal Broker of Record and Vice-President General Sales &amp; Operations for Berkshire Hathaway HomeServices Stouffer Realty, helped oversee the sale. He tells Flyhomes his company required, as part of the Exclusive Right to Sell Agreement, that the sellers \u201cdisclose the history by providing any public and court records to which every buyer had to acknowledge in writing that they are aware of the stigmatized nature of the property prior to the showing of a buyer.\u201d<\/p>\n\n\n\n<p>\u201cWe worked with the Trustees of the estate and our attorneys to make sure every I was dotted and T was crossed to avoid potential litigation,\u201d he adds.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">One person\u2019s fright is another person\u2019s fascination&nbsp;<\/h2>\n\n\n\n<p>It\u2019s true that selling a known haunted house or stigmatized home can come with a unique set of challenges\u2014more on that in a minute\u2014but that doesn\u2019t mean you\u2019re stuck accepting a low offer or, worse, unable to sell.<\/p>\n\n\n\n<p>The previous owner of Dahmer\u2019s home, Chris Butler, is a musician who founded the new wave band The Waitresses in 1978. In an interview with the <a href=\"https:\/\/observer.com\/2018\/02\/interview-musician-chris-butler-on-owning-jeffrey-dahmers-house\/\" target=\"_blank\" rel=\"noreferrer noopener nofollow\"><strong>New York-based culture website Observe<\/strong>r<\/a>, Butler said he fell in love with the home first and <em>then<\/em> was told about its notorious history. Still, he went through with the purchase and enjoyed living there.<\/p>\n\n\n\n<p>\u201cThe house has a great vibe,\u201d he told journalist Tim Sommers. \u201cI mean, after all, the house didn\u2019t kill anybody, and I don\u2019t believe in ghosts, and there\u2019s absolutely no reason to think there\u2019s anything untoward here, other than it\u2019s an old house, and old houses creak, but I am quite positive there\u2019s nothing from the afterlife playing with my clothes dryer.\u201d<\/p>\n\n\n\n<p>Butler is hardly the first artist to find a happy home in a notorious house. Nine Inch Nails frontman Trent Reznor was living in the home in which Sharon Tate was murdered while he recorded the band\u2019s Grammy-winning record <em>The Downward Spiral<\/em> and actor Nicolas Cage once lived in Louisiana\u2019s Lalaurie House, a popular stop for many New Orleans ghost tours.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What to know when selling a haunted house<\/h2>\n\n\n\n<p>There are many helpful tips on the internet to ensure your sale goes smoothly\u2014everything from <a href=\"https:\/\/www.flyhomes.com\/blog\/in-real-estate-what-is-list-price\/\" target=\"_blank\" rel=\"noreferrer noopener\"><strong>how to decide on the right list price<\/strong><\/a> to<strong> <\/strong><a href=\"https:\/\/www.flyhomes.com\/blog\/mistakes-to-avoid-when-selling-your-house\/\" target=\"_blank\" rel=\"noreferrer noopener\"><strong>common mistakes to avoid<\/strong><\/a>\u2014but selling a stigmatized home comes with its own set of challenges that aren\u2019t often talked about.&nbsp;<\/p>\n\n\n\n<p>Here are a few things to keep in mind when you set out to sell your haunted house:&nbsp;<\/p>\n\n\n\n<ol class=\"wp-block-list\"><li><strong>Your house won\u2019t scare off everybody<\/strong><\/li><\/ol>\n\n\n\n<p>The home at the center of New York\u2019s \u201cGhostbusters ruling\u201d may have been a nightmare for the Ackley family, but not everyone experienced the hauntings. One former resident, singer Ingrid Michaelson, <a href=\"https:\/\/people.com\/home\/a-celebrity-owned-new-york-mansion-once-declared-legally-haunted-is-on-the-market-for-1-9m\/\" target=\"_blank\" rel=\"noreferrer noopener nofollow\"><strong>told <em>People<\/em> magazine in 2019<\/strong><\/a>, \u201cIt&#8217;s a magical home. It&#8217;s a memorable home. It&#8217;s a home where people gather, it draws you in and comforts you. And the view is unbeatable.\u201d&nbsp;<\/p>\n\n\n\n<ol class=\"wp-block-list\" start=\"2\"><li><strong>Prepare for the looky-loos<\/strong><\/li><\/ol>\n\n\n\n<p>When Jim Fox was helping prepare Jeffrey Dahmer\u2019s childhood home, he and his colleagues knew the house\u2019s reputation would appeal to true crime fanatics. They had requirements in place to ensure things ran smoothly.<\/p>\n\n\n\n<p>\u201cAll buyers had to provide proof of funds prior to viewing the home,\u201d Jim says, \u201cand no one was allowed to bring in cameras, cell phones, or any recording devices.\u201d<\/p>\n\n\n\n<ol class=\"wp-block-list\" start=\"3\"><li><strong>Watch out for backlash<\/strong><\/li><\/ol>\n\n\n\n<p>If your home is famous\u2014or infamous\u2014enough to draw a crowd, prepare for that as well. While the Jeffrey Dahmer house did get a lot of press while it was on the market, Jim says not everyone was happy with the attention.\u00a0<\/p>\n\n\n\n<p>\u201cThe backlash we received was from neighbors and local law enforcement dealing with increased traffic and people attempting to view the grounds and trespassing on neighbors\u2019 property to view the house through windows.\u201d<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Haunted houses aren\u2019t for everyone<\/h2>\n\n\n\n<p>No, not all buyers are willing to take a chance on a house with a complicated history, but it\u2019s also clear that not everyone is scared away by a stigmatized home, either.
