This Privacy Notice describes how Flyhomes, Inc. and its affiliates and subsidiaries, including Flyhomes Mortgage, LLC (collectively referred to as “Flyhomes,” the “Company,” “we,” “our,” or “us”) collect, use, disclose, retain, and protect the personal information that we process about you. This Privacy Notice applies to the Flyhomes websites, mobile applications, services, features, or content we offer (collectively, the “Services”).

By using Services that display, link to, or refer to this Privacy Notice, you acknowledge the disclosures in this Privacy Notice. When you use our Services, you are accepting the practices outlined in this Privacy Notice and our Terms of Use.
As used in this Privacy Notice, the term “personal information” means any information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household. Personal information does not include information that is publicly available, de-identified, aggregated or otherwise exempted by law.

We may collect, use, or disclose the following categories of personal information for the business purposes described below. Note that the categories of personal information we collect about you may vary depending on the nature of your interactions with us.

3. Sources of Personal Information

We may collect personal information from the following sources:
  • Directly from you. For example, when you provide us information online, through electronic forms, over the phone, or through paper documents.
  • Automatically through our Services. For example, via cookies and other tracking technologies.
  • From our service providers, vendors and suppliers, or other individuals and businesses
  • From public sources of data, such as government databases.
We may receive personal information as part of a corporate transaction or proceeding such as a merger, financing, acquisition, bankruptcy, dissolution, or at transfer, divestiture, or sale of all or a portion of business or assets.
We may also receive personal information from government agencies or courts for legal compliance purposes, to protect your personal safety or the safety of others, to protect our legal and business interests, or to investigate fraud.

4. Disclosures of Personal Information

We may disclose the categories of personal information we collect to the following categories of recipients for operational or business purposes consistent with our purposes for collection, use, and disclosure:
  • Our Affiliates/Third-parties: No Mobile Opt-in Data will be shared with third parties/affiliates for marketing/promotional purposes. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.
    We may disclose personal information we collect about you to our affiliates for the business purposes detailed in this Privacy Notice.
  • Vendors. We may use vendors to help us operate our business and the Services, or to administer activities on our behalf, such as: sending emails, serving advertisements, maintaining the Services, collecting and analyzing data, providing customer service, detecting and deterring fraud or other illegal activities.
  • Other Disclosures. We may disclose your personal information in the following circumstances:
    • ○ as required or permitted by applicable laws;
    • ○ in the event we sell or transfer all or a portion of our business assets (e.g., further to a merger, reorganization, liquidation, or any other business transaction), including negotiations of such transactions, in accordance with applicable laws;
    • ○ where we determine that disclosure of specific personal information is necessary to comply with the request of a law enforcement or regulatory agency or other legal process;
    • ○ to enforce our policies, or to investigate, prevent and take action regarding illegal activities, suspected fraud, to protect legal rights, propriety, or safety; or
    • ○ when necessary to protect our affiliated companies, our employees, our customers, or others.
Real Estate Brokers and Business Partners. We may disclose personal information to the real estate brokers and/or business partners that we work with in connection with making Services available to you.
Marketing Partners. We also send your personal information to our marketing partners who may use such information in connection with promoting services and products that may be of interest to you.

5. Cookies and other Tracking Technologies

We and our vendors may use a variety of tracking technologies that collect certain information when you interact with our Services. Depending on your device and browser settings, these tracking technologies may collect your IP address, device identifiers, user preferences, approximate geolocation, the pages you click on, and the website you visited immediately beforehand. These technologies may also collect details about how you interact with our Services.
We may use these technologies for various purposes, including to provide functionality on the Services, to help us route traffic between servers, to understand how the Services are performing and how visitors use the Services, to improve features and content on the Services, and for advertising purposes. We may combine certain information collected through tracking technologies with other information we obtain about you, which may include information we obtain from our vendors. We or our vendors may collect personal information about your online activities over time when you use the Services.
We may use technologies that monitor and record your experience and interactions with our Services, such as the features you engage with, how you navigate our Services, your keystrokes, cursor movements, scrolling activity, and click-related activity. These technologies may also collect and analyze information from your device, such as your operating system, plug-ins, and system fonts.
Some of the content, applications, and tracking technologies on our websites and mobile applications is controlled by third parties, which include ad tech companies (such as Meta or Google) or other online service providers that serve interest-based advertisements. These third parties may use cookies (both first-party and third-party), web beacons, and other storage technologies (such as the Meta Pixel) to collect or receive information from our websites, apps, and elsewhere on the Internet and use that information to provide measurement services as well as for interest-based advertising. For example, we have implemented Google Analytics Advertising for features such as Remarketing with Google Analytics and Google Analytics Demographics and Interest Reporting. To the extent we grant third parties access to information collected via your mobile device, they are expected to follow privacy practices no less protective than our practices to the extent allowed by applicable law.
You may be able to adjust your browser settings to remove or reject cookies. Some browsers may have a "Do Not Track" setting. Please note that our Services are not designed to respond to "Do Not Track" settings.

Chat Features We may offer interactive chat features on our Services for engaging with our products. When you participate in the interactive chat with a virtual agent, the contents of the chat may be captured and kept as a transcript. In certain instances you may be provided the ability to chat with a live agent if you opt in to do so. By using these features, you understand that our vendors may process the information obtained through the feature to provide the service on our behalf.
Online Advertising We may use a variety of vendors to perform advertising services, some of these companies are members of the Network Advertising Initiative (“NAI”) or the Digital Advertising Alliance (“DAA”) Self-Regulatory Program for Online Behavioral Advertising. You may want to visit https://thenai.org/opt-out/, which provides information regarding targeted advertising and the “opt-out” procedures of NAI members. You may also want to visit http://www.aboutads.info/choices/, which provides information regarding targeted advertising and offers an “opt-out” by participating companies in the DAA Self-Regulatory Program
You can also use mobile device settings to limit mobile tracking technologies and associated activities. For instance, you can adjust or reset the advertising identifiers on your mobile device in the device settings. iOS users can visit Settings > Privacy > Advertising > Reset Advertising Identifier. Android users can visit Google settings > Ads > Reset advertising ID
We are not responsible for the effectiveness of, or compliance with, external-parties' opt-out options or programs or the accuracy of their statements regarding their programs.

6. California Notice

Sales and Sharing of Personal Information
This section supplements the other parts of our Privacy Notice and provides additional disclosures for California residents.
To learn more about the categories of personal information we process, the purposes for processing and disclosure please see Section 2 above. To learn more about the sources of personal information we process please see Section 3 above. To learn more about the categories of recipients to whom we disclose personal information please see Section 4 above.
Some of the ways in which we disclose personal information are considered “sales” or “sharing” under the California Consumer Privacy Act (“CCPA”). Listed below are the categories of personal information we disclose for purposes cross-context behavioral advertising or otherwise sell:

  • Internet or other electronic network activity information
  • Geolocation data
  • Commercial information
The types of third parties to which personal information is sold or shared for cross context behavioral advertising are business partners, third-party advertisers, and analytics vendors. The purposes for which we disclose this personal information include: showing you relevant ads while you browse the internet or use social media; marketing, advertising, certain types of analytics, or similar purposes. We do not have actual knowledge that we sell or share the personal information of consumers under 16 years of age. Privacy Rights
California residents have certain rights relating to their personal information as described below. To exercise any of these rights, please submit a request by emailing us at privacy@flyhomes.com or by calling us at 1-844-405-1430. Please note that we will need to authenticate your identity before your request can be processed. For authentication, you will be asked to verify your identity in accordance with the law.
Right to Know: You have the right to know what personal information we have collected about you, which includes:
(1) The categories of personal information we have collected about you, including:
  • a. The categories of sources from which the personal information was collected.
  • b. Our business or commercial purposes for collecting, selling, sharing, or
  • d. The categories of personal information that we sold, and for each category identified, the categories of third parties to which we sold that particular category of personal information.
  • e. The categories of personal information that we disclosed for a business purpose, and for each category identified, the categories of recipients to which we disclosed that particular category of personal information.
(2) The specific pieces of personal information we have collected about you.
Right to Delete: You have the right to request that we delete personal information we collected from you, subject to certain exceptions.
Right to Correct: If you believe that personal information we maintain about you is inaccurate, you have the right to request that we correct that information.
Right to Opt Out of Sales and Sharing: You have the right to opt out of the sale of your personal information, and to request that we do not share your personal information for cross-context behavioral advertising. To opt-out, please click the “Do not sell or share my personal information” link in the footer of our website. You may also exercise your right to opt of certain sales and sharing via an opt out preference signal. If you choose to use the (GPC) browser signal you will need to turn it on for each browser you use.
In addition, California residents have the following rights, which must be exercised as described below:
  • California's "Shine the Light" law permits California residents to request certain information regarding our disclosure of certain personal information to third parties for their own direct marketing purposes. If you are a California resident, you may request information about our compliance with the Shine the Light law by contacting us at privacy@flyhomes.com or by sending a letter to Flyhomes, Inc., Privacy Requests, 160 NW Gilman Blvd, Ste 441, Issaquah, WA 98027, (Attention: Privacy Requests). Any such request must include "California Shine the Light Request" in the first line of the description and include your name, street address, city, state, and ZIP code. Please note that we are only required to respond to one request per customer each calendar year
  • California Minors. Any California residents under the age of eighteen (18) who have registered to use our online services, and who posted content or information on the online service, can request removal by contacting us at privacy@flyhomes.com detailing where the content or information is posted and attesting that you posted it.

7. State-specific Privacy Rights

This section supplements the other parts of our Privacy Notice, and provides additional information for residents of certain U.S. states other than California. If you are a resident of California, please review our California-specific disclosures, above.
Sales and Targeted Advertising
We may sell the following categories of personal information: Identifiers; Internet or other electronic network activity information; Commercial information; and Geolocation data.
We sell this personal information to our business partners, third-party advertisers and some analytics vendors. The purposes for which we sell this information include: showing you relevant ads while you browse the internet or use social media, marketing, certain types of analytics, or similar purposes. We offer you the ability to opt out of sales and targeted advertising as set forth below.
Privacy Rights
Residents of certain U.S. states other than California may have certain rights relating to your personal information as described below. To exercise any of these rights, please submit a request by emailing us at privacy@flyhomes.com or by calling us at 1-844-405-1430. Please note that we will need to authenticate your identity before your request can be processed. For authentication, you will be asked to verify your identity in accordance with the law.
If you are unsatisfied with the resolution or result of a prior request, you may ask us to reexamine your request by emailing us.
We will not discriminate against you for choosing to exercise any of your privacy rights.
Right to Confirm, Know, or Access: You may confirm whether we are processing your personal information, access your personal information, and obtain a copy of the personal information you provided to us in a portable format.
Oregon residents may also request a list of third parties to which we disclose personal information
If you live in Delaware, you have the right to request a list of the categories of third parties with whom we disclose your personal data.
Right to Correct: You may request that we correct inaccuracies in your personal information, taking into account the nature of the personal information and our purposes for processing it.
Right to Delete: You may request that we delete your personal information. Please note that we may retain certain personal information as permitted by applicable law
Right to Opt Out: You may have the right to opt out of the sale of your personal information, and the use of your personal information for targeted advertising. To opt-out, please click the “Do not sell or share my personal information” link in the footer of our website. You may also exercise your right to opt of certain sales and targeted advertising via an opt out preference signal. If you choose to use the Global Privacy Control (GPC) browser signal you will need to turn it on for each browser you use.
Authorized Agents: Depending on your state of residency, you may have the right to designate an authorized agent to make certain privacy rights requests on your behalf.
Please note that if you make a privacy rights request, we will retain the personal information submitted in connection with your request for recordkeeping purposes.

8. Data Security and Retention

Safeguarding personal information is important to us. While no systems, applications, or websites are 100% secure, we take reasonable and appropriate steps to help protect personal information from unauthorized access, use, disclosure, alteration, and destruction. To help us protect personal information, we request that you use a strong password and never disclose your password to anyone or use the same password with other sites or accounts.
We retain personal information for as long as needed or permitted in light of the purposes for which it was obtained and consistent with applicable law. The criteria used to determine our retention periods include:
  • The length of time we have an ongoing relationship with you and provide our products and services to you (for example, for as long as you have an account with us or keep using our products and services);
  • Whether there is a legal obligation to which we are subject (for example, certain laws require us to keep records of your transaction or communications for a certain period of time before we can delete them); and
  • Whether retention is advisable in light of our legal rights (such as in regard to applicable statutes of limitations, litigation or regulatory investigations).

9. Children’s Privacy

We do not knowingly collect or solicit any information from anyone under the age of 18. In the event we learn that we have inadvertently collected personal information from a child under age 18, we will delete that information as quickly as possible. If you believe that we might have any information from a child under 18, please contact us using the contact details set out at the end of this Privacy Notice.

10. Third-Party Websites

Our Services may contain links to or integrations with other sites, whose information practices may be different than ours. Visitors should consult the other sites’ privacy notices as we have no control over information that is submitted to, or collected by, these third parties. This Privacy Notice only addresses our use and disclosure of your personal information. We are not responsible for the privacy practices of any third parties or the content of linked websites, although we encourage you to read any applicable privacy policies of such parties or websites.

11. Updates

We may modify or update this Privacy Notice from time to time to reflect the changes in Services and applicable law, and you should review this Privacy Notice periodically. We will update the “Effective Date” at the top of this page when we post changes to this Privacy Notice.
